The 'Law on Soil Conservation and Land Use and Amending Certain Laws' has been published in the Official Gazette and entered into force. The new legislation brings numerous important changes, from environmental projects and agricultural distance rules to alcohol advertising bans and penalties for energy and water structures.
STRICT CONTROL ON ALCOHOL ADVERTISING
Bans on companies producing, importing, and marketing alcoholic beverages have been expanded. Any expression, shape, or visual on the name, brand, logo, emblem, and packaging of these firms cannot be displayed inside, outside, in shop windows, at sales units, or in any event area of their premises.
Furthermore, fermented (brewed) alcoholic beverage brands cannot be used as distilled spirit brands, and distilled spirit brands cannot be used as fermented beverage brands.
GRADUAL PENALTIES FOR VIOLATIONS
Graduated sanctions will be applied to real and legal persons operating in the tobacco, tobacco products, macaron, cigarette filter, cigarette paper, alcohol, and alcoholic beverage sectors without authorization under the law or who fail to comply with the rules. Upon the first detection, a minimum of 15 days will be given to rectify the deficiency, or a written warning will be issued to prevent recurrence.
Upon the second detection, if the deficiency is not rectified within 5 years or the same error is repeated a second time within 5 years, an administrative fine ranging from 100 Turkish Liras to 1 million Turkish Liras will be imposed. Upon the third detection, if the violating act is committed for the third time within the same 5-year period, all documents related to the company's type of activity will be revoked.
NEW STEP FOR FORESTS
The General Directorate of Forestry is taking a new step to reduce the effects of global climate change and increase forests' greenhouse gas sequestration capacity. In this context, 'carbon sink forests' will be established to capture and store atmospheric carbon, contributing to the fight against climate change.
DISTANCE SETTING FOR RICE PADDIES
The new regulation redefines the distance limits of rice paddies from residential areas. Accordingly, rice paddies can be established at least 500 meters from the zoning boundary in provincial and district centers, and at least 50 meters from the outermost perimeter of the house in villages and neighborhoods, measured from the closest point between the field and the house.
EXTENSION FOR WATER PROJECTS
The completion deadline for unlicensed bilateral cooperation projects carried out by the State Hydraulic Works (DSİ) and projects included in past investment programs has been extended from December 31, 2025, to December 31, 2040. On the other hand, the issue of security for water structures such as dams, ponds, Hydroelectric Power Plants (HPPs), and irrigation canals built by DSİ has been clarified.
To prevent drowning incidents that may occur in ponds and dams entered for cooling, especially in summer months, and accidents on unprotected facility roads, provincial special administrations, municipalities, village legal entities, and other public institutions will be obliged to take necessary security measures within their areas of responsibility and inform DSİ.
Water structures, service roads, and other elements owned by DSİ cannot be used for purposes other than their intended use. In cases of mandatory misuse, the individual will be responsible for all resulting damage.
SUGAR BEET PRICES TO BE SET BY AGREEMENT
According to a provision closely concerning sugar beet producers, sugar beet prices will no longer be determined by a fixed system each year but will be set according to an agreement (consensus) reached between real/legal persons operating sugar factories and producers or their representatives.
HEAVY SANCTION FOR ANIMAL SHIPMENT WITHOUT DOCUMENTS
A per-animal fine will be imposed on owners who ship live animals and animal products without the mandatory documents determined by the Ministry of Agriculture and Forestry. It will be applied as 7,863 Liras per animal for cattle (large livestock) and 1,204 Liras per animal for sheep and goats (small livestock).
