The TBMM Plan and Budget Commission accepted the Law Proposal on Amendments to Certain Laws, which includes changes related to the security organization and the press field. The proposal reorganizes both the administrative structure of the Security Organization and the rules for newspapers, magazines, and internet news sites.
Highlights
- Maximum staff ratios for officer ranks in the security organization have been redefined.
- A new application right was granted for some police officers who graduated by court decision after leaving school due to health reasons.
- The area of revenue-based taxation for those transporting passengers by taxi has been expanded.
- New qualifications and duties were defined for internet news sites in the official announcement and advertising process.
- A sanction of cutting announcements and advertisements was introduced for media outlets that do not comply with obligations.
Staff ratios in the security organization are changing
According to the proposal, to increase management capacity in the Security Organization, strengthen supervision and oversight mechanisms, accelerate decision-making processes, support personnel motivation, and develop specialization, the maximum ratios for officer ranks will be reorganized.
The new ratios are set as 65 per 10,000 for first-class police chief, 75 per 10,000 for second-class police chief, 90 per 10,000 for third-class police chief, 100 per 10,000 for fourth-class police chief, 300 per 10,000 for police officer, 310 per 10,000 for chief inspector, 320 per 10,000 for inspector, and 330 per 10,000 for assistant inspector. With this change, the temporary provision regarding previous ratios will be repealed.
New path for police officers dismissed due to health reasons
The proposal also includes a regulation for those dismissed from the General Directorate of Security's educational institutions due to not meeting health requirements. Those who continued their education by court decision, graduated, and were appointed to the Security Services Class as police officers or police chiefs, but were later dismissed from civil service by a health-related court decision, may be appointed to a suitable position in the General Administrative Services Class if they apply within 6 months from the enforcement of the regulation.
In these appointments, compliance with the conditions in the Civil Servants Law and health requirements for appointments to other service classes outside the Security Services Class will be sought. Procedures and principles for these open appointments will be determined by the General Directorate of Security.
New tax regulation on taxi revenues
One of the changes in the Income Tax Law concerns those transporting passengers by taxi. Accordingly, those who document all their revenue from this activity with a taxi financial device used without an electronic fee collection system can be taxed on their determined earnings upon request.
Those within this scope can benefit from the revenue-based earnings determination method for up to 3 years starting from the beginning of the year following the request date. Additionally, the discount authority granted to the President for the determination rate will be limited to those other than taxi passenger transporters.
Another change exempts income from the sale of commercial plates of taxis, minibuses, and public service vehicles owned by income taxpayers taxed on a real basis before the regulation's enforcement from income tax.
Care centers for disabled and elderly can be opened in forests
The amendment to the Forest Law opens the way for care and rehabilitation centers for disabled and elderly individuals owned by the state to be opened in forest areas. The proposal contains provisions expanding the administrative framework on this matter.
New rules for internet news sites
With the amendment to the Law on the Organization of the Press Announcement Institution, the qualifications and duties of internet news sites will be clarified. Criteria such as "number of news", "content", "staff", "number of readers", and "minimum publication life" for internet news sites that receive or are in the waiting period for official announcements and advertisements will be determined by the General Assembly of the Press Announcement Institution.
The duties related to newspapers in the law will also apply to internet news sites. Thus, a new supervision framework linked to the official announcement and advertising regime will be established in the field of digital publishing.
Limits and increases of sanctions in case of repetition
The proposal also reorganizes the sanction mechanism for newspapers, magazines, and internet news sites that do not comply with the specified qualifications, duties, and obligations. The Board of Directors of the Press Announcement Institution can decide to cut official announcements and/or advertisements for 1 to 10 days, considering the nature, severity, and duration of the violation.
During this period, the relevant media outlet will not benefit from other advantages provided by law. It is stated that the decision will be applied by not giving announcements for those with the right to publish official announcements and advertisements, and by removal from the list for those with only the right to publish official advertisements.
The sanction decision for media outlets in the waiting period will take effect after gaining the right to publish official announcements and advertisements. Within 1 year from the notification of the decision, for the first repetition of the same violation, a penalty of 5 to 15 days, for the second repetition 10 to 20 days, and for the third and subsequent repetitions 15 to 25 days of announcement and advertisement cut will be applied.
If the violation period exceeds one month, the number of penalty days will be doubled. If there are violations in more than one area, the durations will be added, but the total sanction that can be applied at once cannot exceed 60 days.
Sanctions also for producers and public institutions
According to the regulation, producers and the producer institution affiliated with public administrations and organizations that do not comply with the provisions can be closed for up to 2 months by the decision of the Board of Directors. The finalized decision will be enforced by the governorship in the relevant place.
Disciplinary action will be taken against the responsible persons of public administrations, organizations, and their partnerships according to their own legislation upon notification by the General Directorate. The result of the action will be reported to the Press Announcement Institution. The institution's right to object to these actions is reserved.
Judicial recourse can be made against sanction decisions according to the provisions of the Administrative Judicial Procedure Law. Procedures and principles regarding the implementation of the regulation will be determined by a regulation issued by the General Assembly.
Context: The proposal foresees changes in a wide range from the security organization to tax applications and digital journalism. Completion of the commission stage brings forward the next steps of the regulation in the parliamentary calendar.
