At the trial held at the İzmir 1st High Criminal Court, the public prosecutor presented the final opinion on the merits concerning defendants B.Ö. and E.G. over the death of infant Altay and the poisoning of five people.
The prosecutor sought prison sentences of between 3 years and 22 years and 6 months for the defendants for “causing death and injury through conscious negligence.” The lawyers for the parties requested time to prepare their defenses against the opinion.
The court ordered the defendants to remain in their current legal status and postponed the hearing. Altay’s father, Recep Kınalı, his mother, Raziye Kınalı, the defendants and the lawyers for the parties attended the hearing.
Witnesses heard at the hearing
M.E., the owner of the apartment where the pesticide treatment was carried out, testified that his sibling had found the company and that they had given the company’s employees the key to the apartment for the treatment. M.E. said the company had warned them not to enter the apartment for three days after the treatment.
M.E. said company representatives had told them they would come to the apartment after the treatment to open it, that they had informed the neighbors in the building that the treatment would be carried out, and that the person who conducted the treatment had said they would notify the residents of the other apartments. The witness said no warning notice had been posted in the building.
Witness S.G. said the people who conducted the treatment had asked that the residents of the other apartments be notified, but that not all residents of the building could be reached. Detained defendant B.Ö. also claimed that he had met with the witness and the witness’s sibling at the apartment before the treatment and that they had told him no one would be in the other apartments.

Background to the incident
One-year-old Altay Toprak Kınalı was poisoned and died three days after pesticide treatment was carried out at an apartment building in İzmir’s Konak district on Nov. 11, 2024. Five people who were taken to the hospital were discharged after receiving treatment, while the building was evacuated.

B.Ö., an employee and the owner of the pesticide treatment company, and E.G., who assisted with the treatment, were detained. The two suspects were released under judicial-control measures after being arrested.
The Justice Ministry’s 5th Specialized Board of the Council of Forensic Medicine issued an opinion that infant Altay died as a result of exposure to chemical phosphine gas. The 1st Specialized Board of the Council of Forensic Medicine also concluded that the death resulted from poisoning caused by the pesticide used against insects in the building.
Following these reports, B.Ö. and E.G. were arrested again. In the indictment prepared by the İzmir Chief Public Prosecutor’s Office, life imprisonment was sought for B.Ö. and E.G. for “intentional killing using a chemical weapon,” while separate prison sentences of up to four years were sought for each of them for “intentional injury using a weapon” in relation to the poisoning of five people.
The indictment was accepted by the İzmir 1st High Criminal Court. At the first hearing, the court had ordered the release of defendant E.G. under judicial-control measures.
