A regulation prepared by the Ministry of Trade to ease calculations for companies with capital losses or that are insolvent was published in the Official Gazette and entered into force.
The communiqué regulating the procedures and principles for implementing Article 376 of the Turkish Commercial Code No. 6102 was amended.
Items to be excluded from calculations
Under the regulation, all foreign-exchange losses arising from liabilities denominated in foreign currencies that have not yet been performed may be excluded from calculations through January 1, 2028.

Within the same scope, half of the total expenses arising from leases accrued in 2020 and 2021, depreciation expenses and personnel expenses may also be excluded from the calculations.
The application was previously limited to calculations made through January 1, 2027. Under the new regulation, this period has been extended to January 1, 2028.
