Changes are planned for the I-539 and I-765 forms used in US immigration applications. Under the new arrangement, only current versions are expected to be accepted from September 15, 2026, while older versions are expected to be returned without being processed.
The I-539 form is used for applications to extend or change status, while the I-765 form is used for work permit applications. The new forms should not be submitted before September 15.
Groups that may be affected by the changes
- F-1 students
- J-1 exchange program participants
- Foreign press workers
- People seeking to extend or change their status
- Spouses and children with H-4 status
- People applying for a work permit
Changes are also planned for the system governing the length of stay of people with F, J and I status on the same date. Under the new system, the period of stay in the US will be limited to a specified date, and people whose authorized period is insufficient will need to apply for an extension.
People with H-1B status are not directly covered by the changes. However, family members with H-4 status and people seeking to change from student status to H-1B status will need to follow the new rules.
The date on the form to be used should be checked before an application is submitted.
