According to the indictment prepared by the Büyükçekmece Chief Public Prosecutor's Office, 9-year-old B.B.T., a student at a private education and rehabilitation center, was subjected to violence by his teacher İbrahim Halil Kağa (31).
Father became suspicious and recorded with his mobile phone
The child's father, İ.T., became suspicious after noticing changes in his son's behavior and his reluctance to go to school. On the day of the incident, when he took his child to school, the boy said, 'Dad, I'll go to school but you wait for me at the door,' prompting the father to move to a spot where he could see the classroom. He then recorded the teacher slapping his son.
Father İ.T. later stated that he warned the teacher and went to the police to file a complaint.
Child described teacher's mistreatment
In his statement, the victim B.B.T. said that his teacher hit his head on the table, slammed him against the wall, grabbed his throat and pushed his chin.
Defendant teacher's defense
The detained defendant İbrahim Halil Kağa stated that he had been a special education teacher for about 7 years and that the victim had a severe intellectual disability. He claimed that on the day of the incident, during the lesson, the child kept looking outside and said, 'There is a severed head there,' and then he saw someone running away quickly but did not realize it was the father. He argued that he was trying to refocus the child to prevent a crisis, and while attempting to control him, his hand accidentally hit the child's chin hard, and he did not strike him.
Forensic report and indictment findings
The report by the Büyükçekmece Forensic Medicine Branch Directorate noted that the child was subjected to a traumatic act constituting a violation of bodily integrity, that the injury could be remedied with simple medical intervention, and that due to his age, he was in a state where he could not defend himself physically or mentally.
The indictment stated that according to the video recording, the defendant grabbed the child by the neck, pressed him onto the desk, and struck his chin, emphasizing that the defendant's statements were aimed at evading the crime.
Prison sentence sought
The prosecution requested that İbrahim Halil Kağa be sentenced to between 9 months and 2 years and 3 months in prison for 'intentional injury of a person who is unable to defend themselves physically or mentally by abusing the influence of a public official.' The indictment was accepted by the Büyükçekmece 2nd Criminal Court of First Instance.
